General Use of Services
By using the AllHome website and all its related services, pages, and materials ("Website"), you agree to comply with any and all guidelines, notices, operating
rules and policies and instructions pertaining to the use and/or access of the Website, as well as any amendments to the aforementioned, issued by ALLHOME
CORP. (the "Company", "AllHome", or "We"/"Us") from time to time. We reserve the right to revise these guidelines, notices, operating rules and policies and
instructions at any time and you are deemed to be aware of and be bound by any changes to the foregoing upon their publication on the Website.
1. You agree and undertake not to:
a. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity on or in connection with the Website;
b. Use the Website for illegal purposes, or for the benefit of any third party;
c. Attempt to gain unauthorized access to or otherwise interfere or disrupt other systems or networks connected to the Website;
d. Collect and/or store any personal information or any other information about other users of the Website without the proper authorization or permission;
e. Interfere with, manipulate or disrupt another's utilization and enjoyment of the Website, and
f. Use the Website other than in conformity with the acceptable use policies of any connected computer networks, any applicable Internet standards and any
other applicable laws.
2. AllHome reserves the right, but shall not be obliged to:
a. Monitor and investigate any violation of the Terms and Conditions contained herein and may take any action it deems appropriate;
b. Report any activity it suspects to be in violation of any applicable law, statute, or regulation to the appropriate authorities and cooperate with such authorities;
and/or
c. Request any information and data from you in connection with your use of the Website at any time and exercise its right under this section if you refuse to
divulge such information and/or data or if you provide or if it has reasonable grounds to suspect that you have provided inaccurate, misleading or fraudulent
information and/or data.
3. Use of the Website is limited to authorized users who are of legal age and who have the legal capacity to enter into and form contracts under any applicable law. Users who have breached or are in breach of the Terms and Conditions contained herein and users who have been permanently or temporarily suspended from use of the Website may not use the Website even if they satisfy the requirements of this Clause 3.
Account
1. You may create an account ("Account") in relation to the use of the Website and in accordance with these Terms and Conditions by selecting or creating a
username and a password, and inputting or entering any other required information. AllHome reserves the right to request that you update your information
without giving a reason or any prior notice. You shall be responsible for the security of your Account and shall notify AllHome immediately if you have knowledge
or have reason to suspect that the confidentiality or privacy of your Account has been compromised.
2. All actions, transactions, orders or communication referable or connected to your Account shall be deemed to be access to the Website by you and information or communication validly transmitted or issued by you. You agree to fully indemnify AllHome against any and all loss, damage, liability or claim arising from your
Account.
3. You agree that AllHome may, for any reason, in its sole discretion and with or without notice or liability to you or any third party, immediately terminate your
Account, cancel any transactions associated with your Account, and/or take any actions that AllHome deems necessary in the following instances, actual or
suspected:
a. Extended periods of inactivity;
b. Violation of these Terms and Conditions;
c. Illegal, suspicious, defamatory, or fraudulent behavior or actions; d. Having multiple Accounts;
d. Abnormal or excessive ordering of Products; or
e. Legal actions or law enforcement actions commenced in relation to your Account.
Privacy
By using or accessing, or providing information on the Website, subject to our Privacy Policy, you consent to AllHome's use, collection, disclosure and/or
processing of your personal data and Account information as described in the Privacy Policy.
Intellectual Property
1. All content, trademarks, service marks, brand names, logos and other intellectual property ("Intellectual Property") in and to the Website are owned, licensed to
or controlled by AllHome, or, where applicable, AllHome's suppliers and service providers. AllHome reserves the right to enforce its Intellectual Property rights to
the fullest extent of the law. No right or license is granted directly or indirectly to any party accessing the Website to use or reproduce any Intellectual Property,
and no party accessing the Website shall claim any right, title or interest therein.
2. No part or parts of the Website may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed,
broadcast, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means or stored in an information retrieval system or installed on
any servers, system or equipment without our prior written permission or that of the relevant Intellectual Property owners.
Limitation of Liability
1. The Website is provided on an "as is" and "as available" basis. All data and/or information contained in the Website is provided for informational purposes only.
No representations or warranties of any kind, implied, express or statutory, including the warranties of non-infringement of third party rights, title, merchantability,
satisfactory quality or fitness for a particular purpose, are given in conjunction with the Website. Without prejudice to the generality of the foregoing, we do not
warrant:
a. the accuracy, timeliness, adequacy, commercial value or completeness of all data and/or information contained in the Website,
b. that Website access will be uninterrupted, secure or free from errors or omissions, or that any identified defect will be corrected;
c. that the Website is free from any computer virus or other malicious, destructive or corrupting code, agent, program or macros, and
d. the security of any information transmitted by you or to you through the Website. You accept the risk that any information transmitted or received through the
Website may be accessed by unauthorized third parties and/or disclosed by us or our officers, employees or agents to third parties purporting to be you or
purporting to act under your authority. Transmissions over the Internet and electronic mail may be subject to interruption or delay due to internet traffic or
incorrect data transmission.
2. AllHome shall not be liable to you for any claims, losses or damages whatsoever or howsoever caused arising directly or indirectly in connection with:
e. any access, use and/or inability to access or use the Website;
f. reliance on any data or information made available through the Website;
g. any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code,
agent program or macros;
h. any use of or access to any other website or webpage linked to the Website and other websites or webpages not under the control of AllHome, and
i. any misunderstanding, error, damage, expenses, or losses resulting from the use of the Website.
Shipping
We accommodate deliveries in areas within the 5 km radius of any AllHome branch. Delivery is subject to the availability of the Products, the shipping option
selected, and other prevailing conditions. Some Products cannot be shipped to places outside Metro Manila or are subject to other restrictions. All delivery
timeframes given are estimates only and delays can occur. In the event of delay, we will inform you accordingly via e-mail. AllHome shall not be liable for any such
delays.
Shipping rates for many Products are weight-based. The weight of any such Product can be found on its detail page. Upon the placement of an order, we estimate
the delivery time and provide you with the applicable shipping rates depending on the shipping option.
You may also opt to pick up your order at the nearest AllHome branch with the Products in stock, provided that you furnish proof of payment of your order. Pick-up of cash on delivery (COD) or unpaid orders at AllHome branches shall not be allowed. AllHome reserves the right to decline to entertain you if you are unable to present proof of payment.
AllHome shall send you a notification via SMS and/or e-mail when your order is ready to be shipped or delivered, or ready for pickup at the AllHome branch nearest to you, and shall require you to send a response confirming your order within three (3) days from receipt of the notification. AllHome reserves the right to cancel your order if you are unable to send your confirmation within the three (3)-day period, but will refund any payments made through bank deposit, debit/credit card, or online payment applications.
Cancellation
Once payment is made and confirmed, orders can no longer be cancelled except when at least one of these circumstances is present.
1. Illegal, fraudulent or suspicious activity associated with the Account;
2. Any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code,
agent program or macro which has affected or which may affect the integrity of the orders or the Website;
3. Any Force Majeure event that renders the transaction impossible or illegal, or
4. Failure to pay or furnish AllHome of proof of payment within 24 hours from the time order is placed.
5. Failure to confirm the order within three (3) days from receipt of the notification from AllHome that the order is ready for shipping or delivery. For payments made thru bank deposit, GCash, and PayMaya, deposit slip or proof of payment must be emailed to [email protected] within 24 hrs. after order is placed.
General provisions
1. The provisions of these I erms and Conditions and our rights and remedies under these Terms and Conditions are cumulative and are without prejudice and in
addition to any rights or remedies we may have in law or in equity, and no exercise by us of any one right or remedy under these Terms and Conditions, or at law
or in equity, shall operate so as to hinder or prevent our exercise of any other such right or remedy as at law or in equity.
2. Our failure to enforce these Terms and Conditions shall not constitute a waiver of these terms, and such failure shall not affect the right later to enforce these
Terms of Conditions.
3. If at any time any provision of these Terms and Conditions shall be or shall become illegal, invalid or unenforceable in any respect, the legality, validity and
enforceability of the remaining provisions shall not be affected or impaired thereby, and shall continue in force as if such provision was severed from these Terms
of Conditions.
4. We may seek immediate injunctive relief if we make a good faith determination that a breach or non-performance is such that a temporary restraining order or
other immediate injunctive relief is the only appropriate or adequate remedy.
5. We may by notice through the Website or by such other method of notification as we may designate, vary the terms and conditions of these Terms and
Conditions, such variation to take effect on the date we specify through the above means. If you use the Website after such date, you are deemed to have
accepted such variation. If you do not accept the variation, you must stop access or using the Website. Our right to vary these Terms and Conditions may be
exercised without the consent of any person or entity.
6. Any typographical, clerical or other error or omission in any acceptance, invoice or other document on our part shall be subject to correction without any liability on our part.
7. You acknowledge and agree that any records maintained by us or our service providers relating to or in connection with the Website shall be binding and
conclusive on you for all purposes whatsoever and shall be conclusive evidence of any information and/or data transmitted between us and you.
8. We reserve the right to delegate or sub-contract the performance of any of our functions in connection with the Website and reserve the right to use any service providers, subcontractors and/or agents on such terms as we deem appropriate.
9. You may not assign your rights under these Terms and Conditions without our prior written consent.
